Finding a House

Normally there are two ways of acquiring a home: by purchasing or renting. In the case of purchase, the contract of sale is registered publicly.This means that the contract is signed before a notary public and it is then registered at the Land Registry. In the case of renting, a private document is usually drawn up between the two parties, in which the proprietor must register and place the deposit arising from the contract with the Bizilagun service.

Housing can be private, state subsidised or public. There is a public service for the rental and purchase of social housing (it can be accessed by registering with (Etxebide) as well as private estate agents

It is presumed that the buyer acquires ownership of the dwelling and must therefore pay the value or price of the property.

Renting a property. An agreement is necessary between the owner of the dwelling (proprietor of the property for rent) and the tenant (who will rent the property), in a private document which is called a rental contract.

It is presumed that the tenant will periodically pay a sum of money to the owner of the dwelling.

Types of dwellings

Dwellings can be:

Freehold properties.Its price or rent is decided by its proprietor.

In the municipality of Basauri, if you are looking for a freehold property, information can be found at estate agents and/or building promoters, in local newspapers, on webpages or property portals.

Protected properties.The price or rent is lower than that of a freehold property.

In this case you can look up the information and register on the Basque Housing Service Register "Etxebide" at internet, or in person atthe Basque Government Housing Office or at the public municipal company Bidebi Basauri SL.

Applications can be handed in at the the Basauri Town Council’s Citizen Information and Attention Office (OIAC).

 

Basque Housing Service "Etxebide"

To apply for a protected dwelling for purchase or to rent, it is necessary to register on the Basque Housing Service list "Etxebide" and fulfil the following requirements:

  • Is over 18 years old, or is an emancipated minor.
  • Is registered as resident in Basauri or another town in the Basque Country.
  • Has not obtained protected accommodation over the two years preceding the application, except in the case of rented accommodation.
  • Provide evidence of minimum income and which must not exceed the maximum income.

Data are checked by the Authorities.

In the case of foreign nationals it is essential to have valid authorisation of residence. If wishing to choose the option to purchase, the authorisation must be long term.

The Basque Housing Service "Etxebide" also offers grants for the purchase of a dwelling and for renting.

Dwelling maintenance

The proprietor of the dwelling has the legal obligation to maintain the property in good condition.

Aseries of public grants are available for renovating the dwelling and/or the building , for improving access and energy efficiency.

You should let us know at Basauri Town Hall’s local social services if you find yourself in a vulnerable situation and you need accommodation urgently.

Risk of eviction

In the case of a risk of eviction, contact can be made through the municipal social services with the Mortgage Mediation Service that provides advice on evictions.

BIZILAGUN is a free public service for everyone that provides mediation for residents and neighbours of the same building who are in disagreement and/or among proprietors and those who rent a dwelling or premises.
